Head of the State Duma Committee on the Financial Market Anatoly Aksakov introduced a draft law, providing for a complete ban on the use of DFA and DRM in Russia for payment for goods and services.
The draft law is called “On Amendments to Certain Legislative Acts” of the Russian Federation in terms of regulating the circulation of digital financial assets and utilitarian digital rights".
The head of the committee Aksakov said, that the authors of the initiative are seeking to increase the investment attractiveness of the use of digital rights by business. We are talking about investment platforms and information systems, with the help of which digital financial assets are issued. And also about preventing the use of digital financial assets (CFA) and utilitarian digital rights (UCP) as a means of payment.
“The changes are aimed at eliminating the risks of using DFA and DRM as a monetary surrogate by establishing a direct ban on the transfer or acceptance of DFA and DRM as consideration for transferred goods, work performed, services provided, as well as another way, allowing to assume payment by DFA of goods (works, services)».
Control over the implementation of the law is assigned to DFA exchange operators, information systems and investment platforms (crypto exchange).
If the fact of payment is established, write the authors of the project, the exchange operator is obliged to refuse to secure the transaction, and operators of information and investment platforms - to ensure that it is impossible for the user to change DFA records.
In addition, the authors of the project propose to provide operators of electronic platforms with the rights to settle transactions with DFA and digital digital currency, and also recognize them as subjects of the national payment system. To control the settlement procedure, all operators of electronic platforms must be included in the register of the Bank of Russia.
The Bank of Russia is vested with supervisory functions, in relation to the national payment system, and the right to apply enforcement measures against operators of electronic platforms, in cases of violations.
Earlier, Anatoly Aksakov told the guests of the press center of the Parliamentary Newspaper:, that the continuation of the active phase of the discussion on methods of regulating the Russian cryptocurrency market does not allow us to expect the rapid appearance of a finished bill.
