The court ordered Sberbank to unblock the accounts of a cryptocurrency trader – Bits Media

A year ago, Sberbank blocked the accounts of a resident of Revda, who was selling bitcoins, for "suspicious" transactions. Sverdlovsk Regional Court ordered the bank to unblock accounts.

Pavel R, a resident of the city of Revda, Sverdlovsk region. from May to August 2020 of the year sold bitcoins using P2P platforms. As part of combating money laundering, Sberbank decided to block the accounts of its client. And he refused to unfreeze accounts even after, as a Revdinets, provided all the necessary documents about the legality of transactions. After that, Pavel filed a pre-trial claim with Sberbank, а затем и подал иск в суд.

In the court of first instance (Ревдинский городской суд) supported the bank's actions. Однако Павел не остановился и подал апелляцию в Свердловский областной суд, which the
admitted the client was right. At the same time, the judicial board for civil cases agreed, that Sberbank had grounds for blocking accounts. However, after the client has provided explanations and the necessary documents, the bank had to remove the lock and restore access to remote banking services.

Суд подчеркнул, that although cryptocurrency trading is not regulated in Russia, there are no prohibitions on this activity.

А вот компенсации морального вреда Павлу добиться не удалось ― суд счел, that the client was using bank accounts for the wrong purposes, which are protected by the law "On Protection of Consumer Rights". Поэтому суд постановил банку разблокировать счета Павла Р., return access to the remote banking system and compensate legal costs in the amount of 5 thousand rubles.

At the beginning of June passed
consideration of the first case in Russia on the appropriation of bitcoins in court, transferred to trust management, at the suit of Petrov and Bashilov.
